Terms of Use — Acorn

1. What this service is

Acorn ("the App") is an iOS app that estimates the nutrition of your meals — calories, protein, carbohydrates, fat, fiber and sugar — from a photo or a text description using artificial intelligence, tracks what you eat against personalized daily targets, and shows your progress over time. Targets are calculated from the profile details you provide during setup (such as gender, age, height, weight, activity level and goal).

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. The App is intended for general wellness use by healthy adults.

3. Free use, subscriptions & trials

• The App can be used without payment, with a limited number of AI meal analyses per week (currently 3). Unlimited AI analyses and premium features require an active Acorn subscription.
• The subscription is offered as an auto-renewable subscription, available as weekly and/or monthly plans, which may include a free trial period as shown at checkout.
• Auto-renewal: unless canceled at least 24 hours before the end of the current period, your subscription automatically renews at the price shown at purchase, and your Apple ID account will be charged for renewal.
• Trial conversion: if you do not cancel before a free trial ends, you will automatically be charged for the subscription you selected.
• Cancellation: you can cancel anytime in your device Settings → Apple ID → Subscriptions. Cancelling stops future renewals but does not refund the current period.
• Payment: all payments are processed by Apple through the App Store. Your payment method is charged by Apple, not by us. Prices are shown in your local currency before purchase.
• Refunds: refund requests are handled by Apple under the App Store's refund policies — we cannot issue refunds directly.
• Subscription management (RevenueCat) may store your purchase and entitlement status to unlock features; see the Privacy Policy for details.

4. AI nutrition estimates & health disclaimer

• Do not rely on the App's estimates for medical dosing (for example insulin), clinical diets, or any decision where inaccurate calorie or macro figures could cause harm.
• Food recognition may misidentify a dish or its portion size; always review and correct estimates before relying on them, and check ingredient labels yourself if you have allergies or intolerances.
• Consult a physician, registered dietitian, or other qualified professional before making significant dietary changes or starting a weight-loss plan, especially if you are pregnant, nursing, under 18, or have a medical condition (including diabetes, kidney disease, or an eating disorder).
• The App is a general wellness tool. It is not intended to diagnose, treat, cure, or prevent any disease.

5. Acceptable use

You agree not to:

• use the App for any unlawful purpose or to submit photos or content that infringe someone else's rights or that you do not have the right to submit;
• attempt to reverse engineer, decompile, or interfere with the App or its backend services;
• use automated means to scrape, abuse, or overload the App's AI analysis features, or to circumvent the free-tier usage limits;
• submit photos containing other identifiable people without their consent.

6. Your data & account

The App uses an anonymous account — optionally linked to your Apple ID via Sign in with Apple — to store your profile, goals and food logs so they persist across sessions. See the Privacy Policy for full details on what is collected and how it's protected. You can delete your account and all associated data at any time from Settings → Delete account & data. If you remain anonymous and reinstall the App or switch devices, a new anonymous account may be created and prior data may not automatically carry over.

7. Intellectual property

The App, its design, its mascot and artwork, and its underlying software are owned by us and protected by applicable intellectual property laws. Estimates and reports generated for you may be used for your personal, non-commercial use. You may not redistribute, resell, or represent content from the App as your own commercial product.

8. Third-party AI & services

The App relies on Google Firebase (Authentication, Firestore, Cloud Functions, Analytics), Google's Gemini AI models, and RevenueCat for subscription management. Availability, accuracy, and performance of AI-generated estimates depend on these third-party services and may be interrupted or degraded outside our control.

9. No warranty and limitation of liability

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or reliability of AI-generated estimates. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages — including any health consequence arising from reliance on AI-generated nutrition estimates or calculated calorie targets. Nothing in these terms limits liability that cannot be limited under applicable law.

10. Termination

You may stop using the App at any time by deleting it from your device and, if applicable, cancelling your subscription through your Apple ID settings. We may suspend or terminate access to the App's backend services if we reasonably believe these terms have been violated.

11. Changes

We may update these terms from time to time. Material changes will be reflected on this page with a new "last updated" date; continued use of the App after a change constitutes acceptance of the revised terms.

12. Governing law

These terms are governed by the laws applicable in the developer's jurisdiction of residence, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your own country provide otherwise.
